Heart of Christmas LLC
Last Updated: September 4, 2026
Welcome to Heart of Christmas LLC (“Heart of Christmas,” “we,” “us,” or “our”). These Terms of Service govern your use of our website, booking services, virtual experiences, appearances, events, and other services offered by Heart of Christmas LLC.
By accessing our website, submitting a booking request, purchasing a service, or participating in one of our experiences, you agree to these Terms of Service.
1. Our Services
Heart of Christmas LLC provides Christmas-themed entertainment and experiences, which may include Santa and Mrs. Claus appearances, private and public events, corporate events, community appearances, virtual visits, video calls, live online events, storytelling, Christmas-themed presentations, motivational or inspirational content, and other related services.
Specific services, availability, duration, pricing, and inclusions may vary and will be described during the booking process or in a separate booking agreement.
2. Booking Requests
Submitting a booking request does not automatically guarantee an event date or time.
A booking is considered confirmed only after Heart of Christmas LLC has accepted the booking and any required deposit or payment has been received.
Clients are responsible for providing accurate information regarding the event, including the date, time, location, number of guests, event type, and any special circumstances that could affect the appearance.
Changes to confirmed bookings are subject to availability.
3. Pricing and Payment
Prices may vary depending on the type of service, event duration, location, travel requirements, date, and other circumstances.
Any required deposit, balance due date, or payment schedule will be disclosed before the booking is finalized.
Unless otherwise stated in writing, additional services or time requested beyond the original booking may result in additional charges.
4. Cancellations and Rescheduling
Cancellation and rescheduling terms may vary depending on the service booked and will be disclosed during the booking process.
Deposits may be nonrefundable when specified at the time of booking.
Heart of Christmas LLC understands that emergencies happen. We may, at our discretion and subject to availability, allow a client to transfer payments toward a rescheduled event.
If Heart of Christmas LLC must cancel an appearance and cannot provide an acceptable alternative or rescheduled date, payments made for the affected service will be refunded as applicable.
5. Event Timing
Clients agree to make reasonable efforts to ensure that events begin at the scheduled time.
Because performers may have multiple appearances scheduled during the Christmas season, late starts may reduce the amount of time available for an appearance.
Additional time cannot be guaranteed.
Heart of Christmas LLC is not responsible for shortened appearances caused by delays outside our reasonable control.
6. Event Environment and Safety
Clients are responsible for providing a reasonably safe environment for performers, staff, guests, and children.
Heart of Christmas LLC reserves the right to refuse, discontinue, or leave an appearance if conditions become unsafe, threatening, abusive, excessively disruptive, illegal, or otherwise inappropriate.
This may include severe weather, dangerous animals, unsafe structures, harassment, threatening behavior, excessive intoxication, or other circumstances that could reasonably endanger performers or guests.
7. Children and Parental Supervision
Heart of Christmas LLC strives to provide positive, family-friendly experiences.
A parent, legal guardian, caregiver, teacher, event organizer, or other responsible adult must remain responsible for supervising minors during in-person and virtual experiences.
Our performers and representatives are entertainers and are not acting as childcare providers.
Parents and guardians are responsible for determining whether an experience is appropriate for their child.
Heart of Christmas LLC does not guarantee how an individual child will respond to Santa Claus, Mrs. Claus, or any other performer. Some children may become nervous, frightened, shy, or overwhelmed, and our performers will make reasonable efforts to provide a comfortable experience.
8. Virtual Visits and Online Events
Virtual experiences may be conducted through third-party video conferencing or social-media platforms.
Clients are responsible for having a compatible device and adequate internet connection.
Heart of Christmas LLC cannot guarantee uninterrupted service when technical difficulties result from internet outages, third-party platforms, equipment failures, or circumstances outside our reasonable control.
A responsible adult should be present or reasonably available during private virtual interactions involving minors.
9. Photos, Video, and Recording
Guests may generally take personal photographs and videos during appearances unless otherwise stated.
Permission to photograph or record an appearance does not automatically grant permission to use Heart of Christmas LLC's name, branding, performers' likenesses, or copyrighted materials for commercial advertising, endorsements, merchandise, or other commercial purposes.
Heart of Christmas LLC will not use identifiable photographs or recordings of children for promotional purposes without appropriate permission when such permission is required.
Separate photography, recording, media-release, or promotional-use terms may apply to particular events.
10. Public Events
Some Heart of Christmas LLC appearances may occur at public events where photography, videography, livestreaming, or media coverage may occur.
Event organizers may maintain their own photography and recording policies. Heart of Christmas LLC is not responsible for photography or recordings independently created or published by unrelated attendees, venues, media organizations, or event organizers.
11. Performer Authenticity and Character Experience
Heart of Christmas LLC provides theatrical Christmas entertainment.
Santa Claus, Mrs. Claus, and related characters are presented as part of an entertainment experience intended to encourage imagination, joy, tradition, and Christmas spirit.
We cannot guarantee that children will believe, continue to believe, or respond in any particular manner to a character experience.
12. Personal Information
Clients may provide information about children or family members to help personalize an experience, such as first names, interests, accomplishments, gift wishes, or other details.
Please provide only information reasonably necessary for the requested experience.
Our collection and handling of personal information is also governed by our Privacy Policy.
13. Website Content and Intellectual Property
Unless otherwise indicated, the Heart of Christmas LLC name, logos, website design, written materials, graphics, videos, photographs, original characters, promotional materials, and other original content are owned by or licensed to Heart of Christmas LLC.
Content may not be reproduced, sold, redistributed, modified, or commercially exploited without prior written permission, except as permitted by law.
14. Social Media and Online Content
Heart of Christmas LLC may publish videos, livestreams, educational material, inspirational or motivational Christmas messages, entertainment content, and other material through our website and social-media platforms.
This content is provided primarily for entertainment and general informational purposes.
Views or opinions expressed during inspirational or motivational content should not be interpreted as professional medical, psychological, legal, financial, or other licensed professional advice.
15. Conduct
Users and event participants agree not to engage in harassment, discrimination, threats, violence, unlawful behavior, deliberate disruption, or inappropriate conduct toward performers, employees, contractors, other guests, or participants.
Heart of Christmas LLC reserves the right to terminate an appearance or deny future services when conduct violates these standards.
16. Circumstances Beyond Our Control
Heart of Christmas LLC will make reasonable efforts to fulfill confirmed bookings.
However, circumstances beyond our reasonable control may affect an appearance, including severe weather, hurricanes, illness, accidents, road closures, vehicle problems, governmental restrictions, power failures, internet outages, emergencies, or other unforeseen events.
When possible, we will attempt to communicate with the client and determine an appropriate alternative.
17. Limitation of Liability
To the fullest extent permitted by applicable law, Heart of Christmas LLC will not be responsible for indirect, incidental, special, or consequential damages resulting from use of our website or services.
Nothing in these Terms is intended to waive rights or exclude liabilities that cannot legally be waived or excluded.
18. Third-Party Services
Our website or services may use or link to third-party services, including payment processors, social-media platforms, video-conferencing services, booking systems, or external websites.
Heart of Christmas LLC does not control and is not responsible for the independent practices, availability, security, or content of third-party services.
19. Changes to These Terms
Heart of Christmas LLC may update these Terms of Service periodically.
When material changes are made, the updated version will be posted on our website with a revised “Last Updated” date.
Continued use of our website or services following an update constitutes acceptance of the revised Terms to the extent permitted by law.
20. Governing Law
These Terms of Service are governed by the laws of the State of Florida, without regard to its conflict-of-law principles.
